Unemployment Benefits: Unemployment insurance benefits are payments made to eligible employees who become unemployed through no fault of their own and are re-trying to enter the job market. In general the rule is if you are terminated you are eligible. Sounds Simple, but the application of these rules and the exceptions to these rules can be complex. In some cases, even if you were terminated, you might not collect if your employer can prove that you committed willful misconduct. In some cases, if you resigned, you might be able to collect if you can show that you resigned for legally sufficient cause due to your employer. If you are denied unemployment benefits, you have the right to appeal this decision. Your attorneys at Rosenberg & Press are versed in the Unemployment Compensation system and will stand by your side and fight for your right to collect.
Wrongful Unemployment/Termination: Federal law protects employees from discrimination on the basis of race, color, religion, sex, national origin, age, and physical disability. Title VII of the Civil Rights Act of 1964 clearly outlines every individual’s right to work without discrimination of pay or placement. The Equal Employment Opportunity Commission governs your rights in the work place. Our attorneys, formerly an attorney with the EEOC, will assist in fighting for your employment rights. Whether you suffered Sexual Discrimination, Age Discrimination, Race Discrimination or Discrimination based on physical handicap, your attorneys will stand by your side.
Whistle Blower: If your employer is performing illegal, immoral or unethical practices, and you’ve been fired or laid off because you spoke up, you may be protected under the Federal Whistleblowers Protection Act (WPA) and State Statutes. You could be protected on a Federal and State level. Meet with your attorneys who will create a plan of action for your case.
